While much of the focus is on the stress tests and banks' efforts to raise cash, the real story is Geithner's Public-Private Investment Program (PPIP), says William Black, an Associate Professor of Economics and Law at the University of Missouri - Kansas City.
The PPIP is the "greatest boondoggle in the history of the world," says Black, a former bank regulator who was counsel to the Federal Home Loan Bank Board during the S&L crisis. As occurred during the S&L era, Black says the PPIP will allow banks to exchange "trash for cash" and turn "real losses into faulty gains."
If the goal of Tim Geithner and other regulators was "to rip off the American taxpayer for the benefit of the least-deserving wealthiest people you can imagine, well - mission accomplished," Black says.

SWENLIN ON WEDGE
Swenlin seems to think this will be brief and rally will then continue.....figure attack of 200 EMA at least.
One of the stronger bear mkt rallys Ive ever witnessed, but for now still IN a bear market. Nothing is for certain, but IF a NEW BULL MKT has commensed....there should be plenty of time to enjnoy the rise, though early on is the most dramatic. This would surprise me to some end, but some of my TA pointed to the possibility, I could never confirm it. And there are missing components that would make this one of a kind.

Take out these temp census GOV jobs (is private sector improving?) and you get another horrible number of 628,000....add back the 30,000 that somehow SLIPPED by last report and you get 658,000.
I smell something unsavory....call me not impressed.....wages FALLING....jobs in delcine.....home values tanked, banks STIFF on lending......demand for credit plunged......but we're in recovery?

ALT A LOANS
Subprime (bad credit mortgage) loans have certainly been generating a lot of attention, and worry, among investors, economists and regulators, but those loans may be only part of the threat posed to the housing market by risky lending.
Some experts in the field are now concerned about the so-called Alt-A mortgage loan market, which has grown even faster than the market for subprime mortgage loans to borrowers with less than top credit.
Alt-A refers to people with better credit scores (A-credit) who borrow with little or no verification of income - so-called alternative documentation.
But some people in the industry call them “stated income” loans, or worse, “liar loans.” And these almost no-doc loans were an important part of the record real estate boom of 2004 and 2005 that has recently shown signs of turning into a bust.
Standard & Poor’s estimates that the Alt-A market has gone from less than $20 billion in home loans in the fourth quarter of 2003 to more than $100 billion in each of the last three quarters.
Overall, new Alt-A mortgage transactions totaled $386 billion in 2006, according S&P’s estimates - up a drastic 28 percent from 2005.
By comparison, bad credit home loans reached a whopping $640 billion in 2006, according to trade publication Inside Mortgage Finance.

Stephen Friedman received a waiver to remain on the board of Goldman Sachs (GS, Fortune 500), the Wall Street firm that became a bank holding company amid September's financial frenzy, according to a report in the Wall Street Journal on Monday. He also holds a substantial amount of shares in the company and continued to buy more even after Goldman came under the Fed's supervision.
DAMN them all......who is looking out for the little guys?....I told you it doesn't matter what party, or who's in power....the rich get richer...the connected stay connected...WTF gave this idiot a "waiver"?

WASHINGTON – President Barack Obama is citing a host of government programs for budget cuts, saying that "these savings, large and small, add up."
The president went before the cameras Thursday to discuss his proposal for roughly 120 budget cuts totaling $17 billion — a sum that would be only about one-half of 1 percent of the $3.4 trillion budget that Congress has approved for next year. (LOL!!!!)
He said he's entrusting budget director Peter Orszag to follow through with the cuts. But there already have been indications that he'll meet some resistance in Congress.
Obama acknowledged that "none of this will be easy." But he said he's determined to cut in half the projected budget deficit in half within four years.

White House budget director Peter Orszag said the president's plan for program cuts is just a start and that a lot more needs to be done to dig the government out of its fiscal hole, especially curbing the growth of the Medicare and Medicaid health care programs for the elderly and the poor.
"But $17 billion a year is not chump change by anyone's accounting," he said. (REALLY?)
Those savings are far exceeded by a phone-book-sized volume detailing Obama's generous increases for domestic programs that will accompany the call for cuts.
And instead of devoting the savings to defray record deficits, the White House is funneling them back into other programs.

The improving trend in initial claims supports the claim that the pace of layoffs is slowing. Unfortunately, the pace of hiring isn't picking up.With employment considered a lagging indicator, though, the improving trend in initial claims is apt to take precedence for the market, which has embraced the idea that the economy has bottomed out.
Anyone else cheering this data? Can we claim the worst is over? Personally I would pray so....continuing claims continue their upward march.....we arent even close to 300,000 per month...then we cheer.
With pomp hype and cicumstance we could see the 200 EMA's in play....will "smart" money who made EASY money cash out or continue to ride this thing? Will that fabled "sideline" cash feel left out and rush into an overbought market?

UBS 'cautious' after $1.7 billion loss
Swiss bank says outlook for the firm is cloudy as global economy continues to worsen.
ZURICH (Reuters) -- UBS remained wary on its immediate outlook as it braced for the full impact of the recession after confirming it had posted a first quarter loss on yet more writedowns and client withdrawals.
Despite a strong rebound in stock markets in recent weeks, UBS (UBS) said the global economy has continued to deteriorate and its home market Switzerland will not be spared. The Swiss economy is set to contract by up to 3% this year.
"The markets continue to be unsettled, and we remain cautious on the immediate outlook for UBS," the world's largest wealth manager said in a statement.

Banks: The financial sector will remain in focus as investors await the release of the results of the U.S. government's so-called stress tests on banks, which are due out Thursday.
At least 10 of the 19 big banks under review -- including Bank of America (BAC, Fortune 500) and Citigroup (C, Fortune 500) -- may need to boost their capital, according to published reports.
Although, the number of reported banks that may need to boost their capital requirements has been fluctuating in the run up to the release of the results.
I will repeat, we are still in a BEAR MKT, and when the trend reasserts itself, MANY will be caught offguard and taken down with it.

IS THE WORST OVER?

The ability to do so has been SO impaired, what we have witnessed from 660 SPX has been short covering....I mean the little guy has been short cicuited or unemployed.
401K contributions and wall street bonuses have been decimated. Ability to draw value from your home near eliminated.
Tightening credit standards have excluded MANY from new money.
Credit cards are chock full.
Mark to mkt end has only put a vail over REAL MKT VALUE.
ALt A loans not in mix nor talked about in MEDIA. Commercial loan defaults JUST beginning their turn at ugly cycle putting MORE stress on banks.
Consumer sentiment may have risen with rally, but it IS coming from lowest point in history.
Stock Market has never proven it knows anything. The economy began to weaken in 1998 yet mkt highs were in 2000.
It is ALL about credit/debt expansion to what 350% of GDP total credit market debt (290% in 1930) in the past when this has POPPED it RETURNS US to MEDIAN trend.....what is current TOTAL CREDIT MKT DEBT? I think still over 300%.
If not THE bottom, what kind of bottom? DID THE SPX PE's OR DIV yields reach levels seen at prior MAJOR CYCLE BOTTOMS? NO
ALL BOTTOMS GET TESTED? usually....dont ya think this one will? 2nd MOUSE here if enterring with more gusto will be unltimate winner.
NO QUESTION...my thinking was failed and masked by my own BIZ experience of despair....had I had only game face on.....SNDK at $5 HNI at $7 DOW and friends under $10 were NO BRAINER TRADES. UYG near $1 a no brainer. There is BIG talk of recovery...I ask you why then UYG under April highs, but supported by 50 EMA and do I see another wedge?

BEAR MARKET RALLIES
YOU SHOULD keep in mind that recovery rallies that occur during extended bear markets are often very impressive. If the rallies were just run of the mill they would not do their job. These rallies will last just long enough to lure in the most that think the worst is over and they let their guard down.
And when these rallies fizzle, and those that jumped back in deny their is trouble brewing in the air, that's when the PRIMARY BEAR TREND reasserts itself with a vengence.
Folks this is a nasty Bear MArket, values will most likely be driven down to never before seen values, with yields near 6%, and SPX 500 PE ratios in single digits......I am sorry to say I do not think we have gotten to the end, and I know the yields and PE's have not met their goals.
The avg person is not trading these markets, the avg person may be reading my blog along with some seasoned traders, but the avg person has been holding this whole time.
The feverish demand for stocks usually met at bear bottoms has been mostly absent here. I think the rally from MArch is most like the one after the 911 panic subsided. I mean WHAT could be worse than the terrorism and pain we felt after being attacked?
I dont remember, but I do know that rally ended and new LOWER prices came after in OCT 2002. And then again in 2003 we came close to the lows, TESTED and didnt look back.
IMHO at LEAST the lows get tested my friends....at the least.
Our problems are deep and wide. Long TERM int rates manipulated lower, even with threat the FED buys its own Bonds...have only risen since....10 yr back above 3.10 % which means mortgage rates will rise......not what was intended....but we KEEP BORROWING TRILLIONS.......there is no spending control iN GOV....
You ask yourself.....or anyone....how ya doing...is it getting better....are the programs taking hold...fixing the problems?
This is the WORST economy in my 50 yr lifetime.....so I wont presume to know how it ends, or improves....I can say I dont see it yet.....and its PRESERVATION MODE for me

The BDI is a good leading indicator for economic growth and production. After all, it doesn't deal with container ships carrying finished goods. It deals with the precursors to production: bulk carriers carrying building materials, cement, grain, coal, and iron. Unlike stock and bond markets, the BDI "is totally devoid of speculative content," says Howard Simons, an economist and columnist at TheStreet.com. People don't book freighters unless they have cargo to move.
SPX 200 EMA is around 965 and sure we could carry to there, sure this rally if gotten in early was a money maker......but the jury is still out to if the BEAR has been defeated....IMHO all I can tell is we are bouncing from news driven by the thinnest of premises.I'm in retail and I cant wait to be proven wrong and stubbornly pessimistic.... watch UYG still below recent high near $3.90 and VIX now below 35....

FED COMMENTS AND GDP
NEW YORK – The Fed confirmed what Wall Street has already concluded: The recession is starting to ease.
Gross domestic product contracted at an annual rate of 6.1 percent, much steeper than the 5 percent forecast by economists polled by Thomson Reuters.
Investors were encourage by a rebound in consumer spending (loss of 6M jobs really?), which accounts for more than two-thirds of U.S. economic activity, and a drop in business inventories. (BIZ adds inv when possitive about economy)
"BETTER THAN EXPECTED"
Better-than-expected earnings have been boosting the market as well. Media conglomerate Time Warner Inc. said its first-quarter profit fell 14 percent on deteriorating ad sales, but the results were better than expected.
Meanwhile, Citigroup, which has also received large amounts of federal aid, is trying to figure out how to retain workers. Citigroup CEO Vikram Pandit has talked with Treasury Secretary Timothy Geithner about the possibility of paying special bonuses to keep demoralized workers from getting scooped up by competitors, a person familiar with the matter said.
TNX (10 yr note) could be ready to explode its 200 EMA is 31.23 near high of the day....leading to higher int rates. (EOD 30.96)

GDP DATA THAT SPURS A RALLY? Buyer Beware
First quarter real GDP dropped at a 6.1% annual rate in part because inventory contraction sliced a whopping 2.8% off the change. Real final sales, excluding inventories, fell at a 3.4% annual rate. Inventories count, though, as the lower levels reflect sharply lower production.
The business data in GDP were terrible. Investment in software and equipment fell at a 33.8% annual rate. Nonresidential construction spending (offices) fell at an amazing 44.2% annual rate. Both of these categories will continue lower. Businesses remain in retrenchment mode even if the rate of decline might slow.
Residential construction spending continued to plunge, and was down at a 38.0% annual rate.
Government spending fell at a 3.9% annual rate as state spending and defense spending contracted. This was another factor in the overall weaker GDP number compared to estimates.

TIME FOR CAUTION
The divergences continue as the rally loses steam and gets older and Bird Flu scare aside, the market is ready to retrace at a bear minimum, some of the gains off the lows.
There is SCANT REAL DATA of any uptick in the REAL ECONOMY, lending standards have stiffened, millions have lost jobs and no longer putting into 401K's, IPO's scarce, investment scarce, Gov and FED programs have had little effect.
Many think bear has been put asleep, but I have no technical data, in fact it is much alive. We have yet to challenge the 200 EMA......when this rally fades, see who steps up to plate, sure isnt avg Koe.

In the first major disclosure of corruption in the $750-billion financial bailout program, federal investigators said Monday they have opened 20 criminal probes into possible securities fraud, tax violations, insider trading and other crimes.The cases represent only the first wave of investigations, and the total fraud could ultimately reach into the tens of billions of dollars, according to Neil Barofsky, the special inspector general overseeing the bailout program.The disclosures reinforce fears that the hastily designed and rapidly changing bailout program run by the Treasury Department and Federal Reserve is going to carry a heavy price of fraud against taxpayers -- even as questions grow about its ability to stabilize the nation's financial system.
Barofsky said the complex nature of the bailout program makes it "inherently vulnerable to fraud, waste and abuse, including significant issues relating to conflicts of interest facing fund managers, collusion between participants, and vulnerabilities to money laundering."The report said little about who is under investigation and how the fraudulent schemes work, but investigators are already on alert for a long list of potential scams. Such schemes could include obtaining bailout money under false pretenses, bilking the government with phony mortgage modifications, and cheating on taxes with fraudulent filings.
Former Bank Regulator Wm Black was interviewed on PBS recently, he says the reason Bank execs have not been replaced is if they did an honest man might try to get to bottom of the issues, abuses and they DON’T WANT THAT!

What they forgot to tell people was an NEW accounting change for GS took DEC figures (and they were bad) off the reporting qtr. And now the banks are free to mark their holdings to a value they see fit vs Mark to Mkt. WHY would FASB do away with mark to market acct? Because it would show most banks INSOLVANT as we speak.

But the bank also took a hefty $13.4 billion provision for loan losses and its shares fell 55 cents, or 5.2 percent, to $10.05 in premarket trading.
The Charlotte, N.C.-based company earned $2.81 billion after paying preferred dividends, or 44 cents per share, compared with a profit of $1.02 billion, 23 cents per share, in the year ago period. Analysts surveyed by Thomson Reuters expected profit of 4 cents per share.
The higher-than-expected earnings could take some pressure off Chief Executive Ken Lewis who has faced calls from some shareholders to either give up his job as chairman or be ousted.

WHERE IS THE SUPPORTIVE DATA?

Expectations for further glimmers of hope on the housing front took a hit this morning. The March housing data were not pretty.
Starts dropped 10.8% to a 510,000 annual rate from 572,000 in February. The level is not as low as the 488,000 dismal January number, but still the second lowest of this cycle.
The March level is well below expectations of about a 540,000 level and below the three-month average of 539,000 the three prior months.
Housing permits gave no indication of an imminent upturn. Permits fell 9.0% to a 513,000 annual rate. This is the lowest level of the current cycle and below the 547,000 average of the three prior months.
There is no reason not to take the data at face value as an indication that housing remains in a deep slump and that sporadic signs of stabilization have to be viewed with caution.

The Fed's latest survey of business conditions nationwide found five of its 12 regional banks reporting a moderation in the pace of the economic decline.

They're afraid that if they admit the truth, that many of the large banks are insolvent. They think Americans are a bunch of cowards, and that we'll run screaming to the exits. WILLIAM K. BLACK: Well, then the banks will, as they did in Japan, either stay enormously weak, or Treasury will be forced to increasingly absurd giveaways of taxpayer money. We've seen how horrific AIG -- and remember, they kept secrets from everyone.
BILL MOYERS: A.I.G. did?
WILLIAM K. BLACK: What we're doing with -- no, Treasury and both administrations. The Bush administration and now the Obama administration kept secret from us what was being done with AIG. AIG was being used secretly to bail out favored banks like UBS and like Goldman Sachs. Secretary Paulson's firm, that he had come from being CEO. It got the largest amount of money. $12.9 billion. And they didn't want us to know that. And it was only Congressional pressure, and not Congressional pressure, by the way, on Geithner, but Congressional pressure on AIG.
Where Congress said, "We will not give you a single penny more unless we know who received the money." And, you know, when he was Treasury Secretary, Paulson created a recommendation group to tell Treasury what they ought to do with AIG. And he put Goldman Sachs on it.
BILL MOYERS: Even though Goldman Sachs had a big vested stake.
WILLIAM K. BLACK: Massive stake. And even though he had just been CEO of Goldman Sachs before becoming Treasury Secretary. Now, in most stages in American history, that would be a scandal of such proportions that he wouldn't be allowed in civilized society.
BILL MOYERS: Yeah, like a conflict of interest, it seems.
WILLIAM K. BLACK: Massive conflict of interests.

Ratigan: Suckers' rally. No question. That's not an indictment of the judgement of the market. That's just my perception of the ability of the banks to function in a timely fashion, the ability to create meaningful amounts of jobs in the immediate future, and the as-yet unrecognized meaningful losses to come in commercial real-estate and other asset classes... We've gone through a transition where things were getting bad in a freefall, and now they're just getting slowly worse. So it's a transition from jumping out a plane without a parachute, and now, after a year of free-fall, we've pulled the parachute, which feels a hell of a lot better than the freefall... I think we're dealing with a problem that has a few years in it, not a few months.

The avg JOE is NOT buying.....he is struggling, looking to PULL OUT IRA MONIES to survive and to which would or could put enormous pressure on stock prices as this before had not been done in ANY meaningful manner.....but I think drawing out retirement funds even if as loan to self is escallating in a big way....I have seen it from those in my own company who have inquired to do so.
The greatest credit/debt bubble of ALL TIMES as part of the K wave, most assuredly has burst and I think once we begin the process of credit contraction, intervention in this cycle will be all but impossible.
If the gov is not knowing where ALL the money is flowing, it is safe to expect a portion is going directly into the stock class. HOW DID WFC achieve "RECORD QTR EARNINGS?"
No improvment on the job front, how is it that the "little people" will now run out and spend it up again and purchase homes/debt on top of it all?
Is the FED/GOV setting us up for a now greater bull mkt the world has ever seen, or an implosion of the likes non has ever witnessed. With world demand drying up...US imports collapsing....is it odd car sales in China hit a record?
DID the recent suspension of mark to market acct, further dilute efforts to deal with the pain and confuse the issue of realizing the losses, the values and exactly what the banks hold and their ability to lend? IS there a line at the bank doors for this money?
AS we try to regain our balance from the real estate collapse.....right around the corner is commercial real estate collapse......I wonder if mkt will rally into end of summer.....then realize they got jobbed.Does anyone expect a V shaped recovery here....so far that is what it is....

Small businesses will be slow to hire back until they see the evidence it is for real…with a potential for 1% growth average for 3-4 years we will as a nation scrape the bottom and flatline and many will still feel it is a recession albeit we will be growing.
· I believe many will use 401K money to get them through tough times….with over 55% of people in “THE MARKET” they will use any bounce for an opp to regain some money and pull it out. The average American 401K balance is sub $60,000!!!! So who is really RICH HERE??? With an older society and many boomers retiring and devastated over the past 9 months in “THE MARKET” you think they are going to keep their money in “THE MARKET”???
· I no doubt believe that the GOVT is goosing the market…they need to change psychology in a major way and if the DOW was in the 6,000’s you think people would want to go and do anything? The human psyche is BIG IN THIS GAME OF “THE MARKET”; but I believe Russell is correct in that no matter what the government does, the BEAR WILL RUN ITS COURSE IN DUE TIME UNTIL IT HAS KILLED EVERY SHEEPLE OUT THERE.
· This is a traders market for at least 2014….until the market bottoms for good…..INVESTING IS DONE.

With every furlough, layoff or stock market drop, Americans of all ages and backgrounds are seeing their incomes dwindle, bills pile up and financial options disappear.
The number who are suffering has increased by 3 million the past year, according to a recent Gallup-Healthways survey. Some 37% of us said we were worried about money last week. Last year, 3.2 million consumers contacted the National Foundation for Credit Counseling, up from 2.2 million in 2007 and 1.4 million in 2006.
"What's happening to families is a perfect storm," says Bob Manning, a finance professor at Rochester Institute of Technology.

DURABLE ORDERS SURPRISE?

Like some other data of late, the February durable goods report turned out to be better than expected. Specifically, orders for durable goods increased 3.4% (consensus -2.5%), breaking a six month streak of declines. Excluding transportation, orders rose 3.9% (consensus -2.0%).
The January numbers, however, were both revised noticeably lower with total orders down -7.3% (prior -5.2%), and orders, excluding transportation, down -5.9% (prior -2.5%). Taking these revisions into account, the February data ends up being much closer to expectations.
The latter point notwithstanding, the February data still don't look as dour as the prior month when declines in orders and shipments were seen for just about every industry grouping. Notably, new orders for machinery increased 13.5% in February. Computers and electronic products orders were up 10.1% and defense aircraft and parts orders were up 32.4%.
Nondefense capital goods orders, excluding aircraft, jumped 6.6%, which is a hopeful sign for business investment. However, it is too early to read too much into this one month increase, which could be more of a temporary bounce after a -11.3% drop in January and a -5.9% decline in December.
Unfilled orders declined -1.3% and inventories dropped -0.9%.
Total shipments fell -0.5% in February, following a -5.2% decline in January, so the business investment component of GDP can still be deemed to be on the poor side of things.

Instead we PILED on MORE DEBT, and now day of reckoning is here. But most do not see the FED as the problem, no we need to make Geithner's powers such as he would be KING? He was at FED during the period of our discontent.....and was architecht of the favortism going on now for Goldman Sachs as $12B was funneled to them from AIG....no one sees that FOX is in the HEN HOUSE.....No one sees the reshaping of the financial world and WHO comes out ahead and WHY!
Did not the FED or GOV SEE the Real Estate explosion? No ONE saw the condo's going up overnight in Miami? The CRANE's in Shanghai? or Dubai? THE RAMPANT speculation that was ALLOWED?
Maybe the GOV has to take over spending when others will not, but we are losing more and more the ability to operate in a free market system and have a say so in how our futures unfold.
